The Terms of Service outline the rules, expectations, and responsibilities that govern how users interact with our website. Their purpose is to ensure a safe, transparent, and reliable experience by defining acceptable use, protecting the organization’s content and systems, and clarifying user rights and obligations. They also help safeguard the organization from misuse, liability, and potential disputes.

Liability 

By accessing and using our website or services, you agree that Royal Architectural Institute of Canada is not liable for: 

Any indirect, incidental, or consequential damages resulting from the use or inability to use our website or services. User-generated content, including its accuracy, reliability, or legality. Unauthorized access to your account or data breaches, despite our adherence to strict security measures. This agreement does not limit liability in cases where such limitations are prohibited by Canadian law, including liabilities arising from gross negligence or willful misconduct. 

In the event of disputes, you agree to resolve matters through binding arbitration in accordance with the Arbitration Act of the relevant province or territory unless prohibited by law. This provision is designed to streamline dispute resolution and reduce legal costs. 

Privacy Policy 

The RAIC complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and all applicable provincial privacy legislation, including the Freedom of Information and Protection of Privacy Act (FIPPA) where required. 

Data Collection: We collect, use, and store personal information solely for purposes related to our programs, services, and organizational goals. Data Sharing: We will not share, sell, or rent your personal information without your explicit consent, except as required by law. Data Protection: We employ advanced encryption, secure servers, and regular system audits to protect your personal information. Transparency: Any changes to our privacy practices will be communicated through updates to our Privacy Policy, available at link to RAIC Privacy Policy. 3. Governing Laws and Regulations 

This agreement is governed by and construed in accordance with the laws of Canada and the province of Ontario. Any disputes must be resolved in the courts of Ontario or through arbitration, as outlined above. Users accessing the site from outside Canada are responsible for compliance with local laws. 

Requesting Deletion of Your RAIC Account

You may request the closure of your online RAIC account at any time. Once your identity is verified, we will deactivate your account and delete or anonymize personal information that is no longer required for legal, financial, certification, or operational purposes.

How to submit your request:
Send an email to membership@raic.org with the subject line Account Deletion Request and include:

  • Your full name
  • Email address associated with your account
  • Member number (if applicable)

We will respond within a reasonable timeframe and inform you of any information that must be retained for legal or audit purposes.

Intellectual Property 

All content on this website, including but not limited to text, images, and code, is the intellectual property of the RAIC. Unauthorized reproduction, distribution, or use is strictly prohibited. 

Users may not copy, reproduce, distribute, or use any content without express written permission. Trademarks, logos, and other proprietary assets are protected under Canadian copyright and trademark laws. 5. Acceptable Use 

By using our website or services, you agree to refrain from activities that: 

Violate Canadian laws, including but not limited to hate speech, harassment, or cybercrime regulations. Upload harmful or unauthorized content, such as malware or defamation. Disrupt or interfere with the normal functioning of our website or services. Violations of these terms may result in account termination, reporting to appropriate authorities, or legal action. 

Dispute Resolution 

Disputes will be resolved in accordance with Canadian laws and the Arbitration Act of the relevant province or territory. Users agree to: Attempt to resolve disputes informally by contacting the RAIC at IT@raic.org Submit unresolved disputes to binding arbitration, except where prohibited by law.  

Changes to Terms of Use 

We reserve the right to update these Terms of Use in compliance with Canadian laws. Updates will be posted on our website with a date stamp indicating the revision. Continued use of our services constitutes acceptance of the revised terms.
